At BLU Creativity, protecting the privacy, confidentiality, and security of our enterprise clients, individual proprietorships, website visitors, and business partners is a core operational commitment. This Privacy Policy details how we process and safeguard information across all digital touchpoints and agency operations.

This Privacy Policy applies to personal and business information collected by BLU Creativity ("Agency," "we," "us," or "our") through our website (www.blucreativity.in), consultation forms, social channels, ad campaigns, and client contracts.

A. Enterprise & Corporate Accounts:

For enterprise clients with customized data security requirements, executed Data Processing Agreements (DPAs) or custom Master Services Agreements (MSAs) take precedence over general privacy terms. Enterprise clients grant BLU Creativity authorization to engage vetted sub-processors (cloud hosts, specialized SEO/analytics platforms) to fulfill campaign obligations.

B. Sole Proprietorships & Individual Accounts:

For individual consultants, freelancers, or sole proprietorships where personal and business identities overlap, personal contact info (e.g., personal phone, residential address, PAN/GST) provided for billing or ad permissions will be processed as business contact data. Credentials granted for client social/ad channels must remain tied to authorized account owners.

Contact & Billing Details: Name, professional title, business entity, email, phone number, billing address, tax registration (GSTIN/PAN), and transactional history.
Delegated Platform Access: Manager or admin permissions granted to Meta Business Suite, Google Ads, LinkedIn Campaign Manager, domain panels, and web hosts.
Telemetry & Usage Data: IP addresses, browser types, operating systems, clickstream, and interaction data via pixels and cookies.

When BLU Creativity manages paid lead generation campaigns (e.g., Meta Instant Forms, Google Lead Extensions) on behalf of clients:

BLU Creativity acts strictly as a Data Processor handling captured lead data.
The Client acts as the Data Fiduciary/Controller and remains solely responsible for placing compliant privacy disclosures and consent mechanisms on their destination landing pages and CRMs.

Executing contracted marketing, web design, branding, and advertising projects.
Communicating project milestones, performance metrics, and invoices.
Sending transactional and promotional communications via email or WhatsApp Business (opt-out available anytime).
Fulfilling legal obligations under Indian GST laws and statutory reporting requirements.

6.1. Regulated Clients (Doctors, Legal, CAs): BLU Creativity does not intentionally collect, process, or store Protected Health Information (PHI) or confidential patient/financial records. Clients must ensure no sensitive unencrypted records are transmitted to the agency.

6.2. AI Processing: We utilize creative SaaS and AI productivity tools (Adobe CC, Figma, ChatGPT, Midjourney). No sensitive personal data or proprietary client secrets are submitted to public AI models for model training.

We do not sell personal information. We share data only with trusted service providers (cloud storage, payment gateways, analytics tools) bound by confidentiality, ad platforms for campaign execution, or where legally required by court orders or Indian regulatory authorities.

Unless governed by a signed Non-Disclosure Agreement (NDA) or custom contractual clause, non-confidential creative work, published campaign assets, and anonymized performance metrics may be featured in BLU Creativity’s portfolio, website, and agency case studies.
